Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the EMAction emergency management platform ("Platform") operated by EMCorp Group Pty Ltd (ABN 21 106 612 800) ("EMCorp", "we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Platform Description

EMAction is a digital emergency evacuation management platform that provides real-time check-in tracking, warden communications, GPS mapping, PEEP management, incident reporting, and AI-assisted situational awareness. The Platform is provided as a service to organisations ("Clients") under a separate subscription agreement. Individual users access the Platform through accounts provisioned by their organisation's administrator.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must not share your login credentials with any other person. If you suspect unauthorised access to your account, contact your organisation's EMAction administrator immediately. We recommend enabling two-factor authentication (2FA) for all warden and admin accounts.

5. Emergency Disclaimer

EMAction is a management and communication tool that supports emergency response. It does not replace emergency services, fire wardens' instructions, or your organisation's emergency procedures. In any life-threatening situation, always call emergency services (000) immediately. EMCorp does not guarantee uninterrupted access to the Platform during an emergency — SMS delivery, internet connectivity, and device availability may be affected by the emergency itself. Your organisation should maintain fallback procedures in accordance with AS 3745.

6. SMS Communications

The Platform uses SMS for incident notifications, verification codes, and warden communications. By using the Platform, you consent to receiving SMS messages at the mobile number registered in your account. Standard carrier message and data rates may apply. SMS delivery is subject to carrier availability and is not guaranteed.

7. GPS Location

GPS location sharing is voluntary and requires your explicit consent via your device's browser permissions. Location data collected during an incident is used solely for the purpose of emergency evacuation management and is stored as part of the incident record. You may revoke location access at any time.

8. AI Features

The Platform includes AI-powered features that analyse incident data to provide advisory information to incident controllers and wardens. AI-generated insights, message tags, notification drafts, and incident summaries are provided as suggestions only and do not constitute professional advice. The Incident Controller and Chief Warden retain full decision-making authority at all times. EMCorp is not liable for decisions made based on AI-generated content.

9. Intellectual Property

The Platform, including all software, design, content, and documentation, is the intellectual property of EMCorp Group Pty Ltd. Your organisation's subscription grants a non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the Platform.

10. Data and Content

Your organisation retains ownership of all data entered into the Platform, including check-in records, incident reports, communications, and uploaded media. We store and process this data on your organisation's behalf in accordance with our Privacy Policy. Incident data, audit logs, and communications are maintained as tamper-proof records and cannot be deleted by individual users.

11. Limitation of Liability

To the maximum extent permitted by law, EMCorp's total liability for any claim arising out of or in connection with the Platform is limited to the fees paid by your organisation for the Platform in the 12 months preceding the claim. EMCorp is not liable for any indirect, consequential, incidental, or special damages, including loss of data, loss of profits, or loss arising from reliance on the Platform during an emergency.

12. Indemnification

You agree to indemnify and hold harmless EMCorp, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Platform.

13. Service Availability

We aim to maintain high availability of the Platform but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. In the event of unplanned outages, we will endeavour to restore service as quickly as practicable.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated to your organisation's administrator. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising in connection with these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.
